Acceptance of Terms: By making any booking via www.swimmingwithsarah.com, you accept all terms and conditions contained herein.
Bookings: All bookings must be made via the online system contained at www.swimmingwithsarah.com. Any such bookings shall not be binding until such time that payment has been made. Any failure to make payment promptly, regardless of cause, shall entitle Sarah to cancel any such booking.
Cancellation/Refund Policy: Cancelations due to thunder will be rescheduled to the best of my ability. Cancellation within 24 hours of lessons will not be refunded. If you do not show up to your scheduled lesson you will not be refunded. Check the weather before booking. If the weather and temperature are fine for me I will still hold and charge lessons as usual. Cancellations prior to 24 hours before the lesson will be refunded.
Limit of Liability: Under no circumstance shall Sarah be liable for any to you or any third party for any loss of use, revenue or profit, or for any consequential, incidental, indirect, exemplary, special or punitive damages whether arising out of breach of contract, tort (including negligence) or otherwise, regardless of whether such damage was foreseeable and whether or not such party has been advised of the possibility of such damages. In no event shall Sarah's aggregate liability arising out of or related to the services, whether arising out of or related to breach of contract, tort (including negligence) or otherwise, exceed the aggregate amounts paid to Sarah for the Services. YOU UNDERSTAND THAT THE USE OF A POOL HAS INHERENT RISKS ASSOCIATED WITH IT AND AS SUCH YOU WAIVE, RELEASE, AND DISCHARGE SARAH FROM ANY AND LIABILITY, INCLUDING BUT NOT LIMITED TO; LIABILITY ARISING FROM SARAH'S NEGLIGENCE OR FAULT FOR DEATH, DISABILITY, PERSONAL INJURY OR ACTIONS OF ANY KID WHICH MAY OCCUR TO YOU OR OUR FAMILY FROM THE USE OF THE POOL AND ITS ASSOCIATED FACILITIES.
